Michelle O’Brien and Tom Irving will present “Low-Hanging Fruit: The FTC’s Recent Actions Scrutinizing Patent Listings in the Orange Book” to AIPLA’s Food and Drug Law Committee on January 18, 2024, at 2 pm ET.
The FTC has had an interest in what it believes to be improperly listed patents and has a history of intervening in patent disputes in furtherance of its interest. Late last year, the FTC advised that it would be scrutinizing patent listing practices more closely. Following the policy statement, the FTC issued letters to several NDA holders informing the companies that it believed more than 100 patent listings were improper. During their presentation, Michelle and Tom will discuss the impact of the FTC’s actions, and what companies who have patents listed in the Orange Book should consider and expect moving forward.
